This is an evolving area of law; the opinions and cases that are shaping the law are happening now. The California State Bar is showing increased interest in investigating "minor" misconduct including advertising and solicitation violations. There can be civil consequences as well under unfair competition laws and in malpractice actions. Every California lawyer should be familiar with the California Rules of Professional Conduct and the duties of attorneys set forth in the State Bar Act (Bus. & Prof. Code §§6000, et seq.) But many attorneys are not.
Even those familiar with the rules and statutes find that their application to real life circumstances is not always clear. The rules and statutes are sometimes ambiguous, sometimes poorly written, and often there is little or no case law interpreting them. Some questions have no clear answers. The amount of law regulating the legal profession has grown steadily for the last few decades; it is no longer enough to rely on what we learned in law school. Even those who specialize in the field of legal ethics find it a challenge to keep up on new developments.
